These terms and conditions of use (“the Terms”) will explain to You when, how, and on what basis You may use the LifePE Ujjwal Saving Foundation Platform (“LifePE Ujjwal Saving Foundation Platform”) being offered to You by Us.

The LifePE Ujjwal Saving Foundation Platform is where a merchant or business can run his business and avail technology-based LifePE Ujjwal Saving Foundation Credit Facility, defined below as cumbers all the grant aspects of a business.

The terms shall be an electronic record under the Information Technology Act, 2000, and the rules framed there including the amendment from time to time. This electronic record is created by a computer program and does not contain any hand or electronic signatures. These Terms are being published as required under Rule 3(1)(a) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code), 2021 made under the Information Technology Act, 2000 (as amended from time to time) to notify Terms of use for access or usage of the LifePE Ujjwal Saving Foundation Platform and Services (hereinafter referred to as LifePE Ujjwal Saving Foundation) and it forms a valid and enforceable legal relationship between Us.

These Terms govern the access and use of the LifePE Ujjwal Saving Foundation Platform hosted at: The terms and conditions set forth herein govern your use of the Website including any amends made and added from time to time.

LifePE Ujjwal Saving Foundation is only an online portal or platform that helps users who already have intentions to avail of business grant Assistance to directly connect with legally authorized entities to business grant as per the RBI Guidelines defined herein-.

For these Terms, the term “patron(s)” shall denote a collective reference to the following entities: Bala ji micro services foundation. Once You choose to proceed further with LifePE Ujjwal Saving Foundation, the term foundation will refer to that particular foundation with whom You chose to proceed.

This set of Terms governs all use of this service, and You agree to abide by these Terms by using this service.

“Admin Verified” shall mean the approval given by the administrator at LifePE Ujjwal Saving Foundation that allows a User to use a particular service or several services provided at LifePE Ujjwal Saving Foundation after the User submits his information, passes through a preliminary check in terms of Know Your Customer (“KYC”), risk assessment, and completion of any other required procedure aiming at the authentications of the User in compliance with the applicable laws including but not limited to the RBI Guidelines.

‘Business Day’ shall mean any day on which banks are open for business in Mumbai, India, and/or New Delhi, India, and or Bangalore, India.

“Business Current Account” or “Payment Account” shall mean a business bank account that the User links to the LifePE Ujjwal Saving Foundation Platform to facilitate the disbursement of grants. The Business Current Account can be Type: New account with any Bank and linked to the LifePE Ujjwal Saving Foundation Platform for SettlementLINE 2: Alternately, an organization can complete the Know Your Client at any Bank and link the existing account to the LifePE Ujjwal Saving Foundation Platform. Any usage of the Business Current Account by any User implies a complete adherence to the policy laid down by the particular bank that the User has conducted the Business Current Account.

Know Your Customer ‘KYC’ shall refer to the various norms, orders, rules, regulations, laws, or statutes by the laws and as provided in the RBI’s Master Directions ‐ Know Your Customer Directions dated February 25, 2016, issued from time to time LifePE Ujjwal Saving Foundation collects personal identification details from the User who intends to access/use the LifePE Ujjwal Saving Foundation Platform.

“User Account” shall mean the actual internet account set up by the User according to the RBI Guidelines and pertinent onboarding criteria posted on the LifePE Ujjwal Saving Foundation Platform.

“RBI Guidelines” shall include the rules, regulations, orders, directions, notifications, guidelines, circulars and other applicable laws issued by the RBI outlined in the Payment & Settlement Systems Act, 2007, RBI directions for opening and operation of accounts and settlement of payments for electronic payment transactions for intermediaries on November 24, 2009 / RBI Directions for Regulation of Payment Aggregator and Payment Gateway Business March 17, 202

“Service(s)” shall mean and include the following services provided by LifePE Ujjwal Saving Foundation to the User at the request of the User:

Performance of Know Your Customer check of the User and creating an account in the LifePE Ujjwal Saving Foundation Platform for the User.

Having supported the execution of the LifePE Ujjwal Saving Foundation Credit sanction letter and the grant agreement with the patron to this end.

To bring to Your notice the details of LifePE Ujjwal Saving Foundation Credit, obtained and interest and principal payments for such grant in the LifePE Ujjwal Saving Foundation Platform.

The LifePE Ujjwal Saving Foundation Platform requires assistance to the User in addressing any queries/clarifications that the User may wish to have regarding the LifePE Ujjwal Saving Foundation Platform.

“Service Provider” shall mean any entity, association of persons, or facility provider, that uses its facilities or services in connection with the provision of the Services.

“Transaction” shall mean the flow of the funds from the patron  to the User concerning the provided grants.

For this agreement “User”, “You”, “Your” and “Yourself” will mean and include a natural person or legal entity (Individual/company/firm/partnership firm / Company / LLPs / trust/societies/HUF, etc.) who registers in LifePE Ujjwal Saving Foundation Platform and/or transacts or utilizes the Services. The term ‘User’ shall also mean any employee of the User including any of its current or previous officers, directors, or employees who log on to the LifePE Ujjwal Saving Foundation Platform using the User Account with either full access or restricted access as appropriate.

Eligibility

The LifePE Ujjwal Saving Foundation Platform can be accessed/used only by persons of eighteen (18) years and above and must be capable of entering into a legally binding contract with Us in compliance with Section 11 of the Indian Contract Act of 1872. Your use or access of the LifePE Ujjwal Saving Foundation Platform shall be deemed as Your covenant that You are capable of entering into a contract and if You enter LifePE Ujjwal Saving Foundation Platform as a business entity, then You warrant and represent that You can able bind such business entity to these Terms.

Assistance from LifePE Ujjwal Saving Foundation

Depending on the assessment conducted by the patron on You, LifePE Ujjwal Saving Foundation will help You to engage with the patron, and, together with You, We will execute the grant documents with the patron for You to use the services of LifePE Ujjwal Saving Foundation Credit.

Subject to Your eligibility limit, the patron will fund the business grant to You. The specifics of Your eligibility limit are listed on Your Account at the LifePE Ujjwal Saving Foundation Platform. Subject to this eligibility limit, You may be allowed to take a business grant from the patron, by agreeing to the disbursal amount and other conditions of the disbursal as may be specified by the patron on the LifePE Ujjwal Saving Foundation Platform or as contained in the grant agreements between You and the patron.

Data, Audit & Security

The warranties of LifePE Ujjwal Saving Foundation to the User comply with the data security measures set forth under the RBI Guidelines as well as the procedures for handling and reporting any incidents that may occur.

Content

In as much as the use of the Services pre-assigns the User rights of using, reproducing, adapting, modifying, publishing, or distributing the Content created and/or stored in the User Account, this shall not be deemed as a license granted to Us unless permitted by the User. However, notwithstanding the same, the User permits us to access, copy, distribute, store, transmit, reformat, or otherwise process /communicate data/content available/ contained in the User Account to provide the Services sought/received by the User.
